Source: A man who was hit and killed while riding his bicycle yesterday as been identified. Police report that 58 year old Abel Palacios was riding his mountain bike when he suddenly moved on to the access road of I-35 near O'Connor Road. That is when the driver of a truck hit Palacios. Police were forced to shut down part of the northbound road. The driver did stop to help.

My husband and I rode our bikes together and he always paid attention to the traffic and was always careful of the roads and everything around him when he was out on his bike. The driver of the truck that hit my husband was going over the speed limit, he was not looking at the road, and even said in the police report that he was “distracted” by (the phone or radio) and admits that he was not looking at the road when he ran over my husband and killed him. The driver didn’t put on his brakes until after he had hit my husband. He was not charged with any violations; He lives the rest of his life without a second thought to his negligent acts that killed my husband. The Laws in Texas NEED TO CHANGED… my husband had every right to be on that road and he was doing everything right… HE did NOT dart out in front of the truck as the newspaper stated; he was riding his bike in a straight line and the driver of the truck came up behind him and hit him going around 45 mph. while he was looking down at his (radio or phone). I am still in shock and disbelief that my precious husband is gone. I want the laws changed in Texas to allow bikers to have their own roads and not share the roads with cars/trucks…it is painfully obvious that as long as they continue to share the roads, the bikers will be run over and killed….and the driver will not be charged with any violations since there are no laws in Texas for “being distracted” while sitting behind a wheel of a moving vehicle. As long as you aren’t drinking alcohol or using drugs, it’s okay to run over a man and kill him according to the Texas Laws.
